No Cure, No Pay (The amicable process).
This is the start of every case. We try to collect your money through letters, emails, phone calls and SMS.
- No results? Then you pay us nothing. No filing fees, no start-up costs, nothing at all.
- Any results? We collect the principal amount plus legal collection costs and interest from your customer. You receive 100% of the principal amount. Our compensation consists of the costs your customer has paid extra.
How does it work in practice? Three scenarios
Debt collection in the Netherlands is fortunately clearly regulated. In the amicable process, we always charge your customer (the debtor) the collection costs and interest.
A trajectory can have three different outcomes. The table below shows you exactly what this means for you at the bottom of the line. The amount under"Net for you" is what is actually deposited into your bank account.
| Situation | Principal | Interest | Collection costs | Total paid | Net receivable |
|---|---|---|---|---|---|
| Fully collected | €300,00 | €4,25 | €45,00 | €349,25 | €300,00 |
| Partially collected | €300,00 | €4,25 | €45,00 | €250,00 | €205,00 |
| Not collected | €300,00 | €4,25 | €45,00 | €0,00 | €0,00 |
Explanation of results:
- Fully collected: Your customer pays the full debt including all fees. You receive 100% of your invoice amount. So our efforts are completely free for you.
- Partial payment: By law, if your customer pays only part, the funds received are first offset against fees and interest. The remainder is transferred directly to you.
- Not collected: Do we unexpectedly fail to collect your money? Then you pay us nothing at all. With us, no result really means no charges. Do you still want to take further steps afterwards? Then - in consultation and after your agreement - we can initiate legal proceedings for you.
No subscription or filing fees
With us, you pay no subscription or filing fees. So you are not stuck with contracts, start-up costs or success fees. You use our online portal for free and as often as you want. Whether you submit a single file or have a large stream of invoices, we charge the same fair and insightful fee model.
What if the customer pays you directly?
It happens frequently: as soon as we send the first letter, the customer is startled and transfers the amount directly to your account. This is good news, because the goal has been achieved!
Because this payment came about through our efforts, it works as follows:
- We proceed for the balance: If the customer pays only the invoice to you, we proceed immediately to collect the remaining interest and collection fees from the customer as well.
- Full payment with you: Do you receive the full amount (including our fees) directly into your account? Then we will settle the collection costs with you afterwards.
- Receive only the principal amount? In the exceptional case that the debtor only pays you the principal sum and the associated collection costs are not collected (in full), we will charge you these collection costs. This is the compensation for the work we have performed for you.
If (full) payment is not made, the case can - only with your agreement - be continued through legal proceedings. If you choose not to do so, the collection costs incurred up to that point will be charged to you.
The exception: when do you pay yourself?
In the vast majority of cases, our assistance costs you nothing at all. However, there are a few situations in which we cannot recover (all) the costs incurred from your client. In those cases, we charge you the collection costs. We believe in fair cooperation, so we are happy to clearly explain these situations:
- File withdrawal: You decide to stop the collection process yourself or withdraw the claim while we have already performed work.
- Your own arrangement or settlement: You make your own payment arrangement or settlement with the debtor during our process outside of us.
- Credit or return: You credit the invoice (partially) or take back goods after the case has already been processed by us.
- Incorrect filing: The claim is found to be not yet due, already paid or substantively incorrect at the time of filing (for example, because the due date has not yet passed).
Debt collection abroad
Different rules apply to foreign debt collection than in the Netherlands. A classic No Cure No Pay approach is often not possible there, because collection costs usually cannot be charged to the debtor. That is why we work abroad according to local laws and regulations.
- Upon full or partial payment, we charge 15% commission on the principal amount collected;
- In addition, we charge a fixed fee of €50 per file.
A foreign debt collection is any case where your client is outside the Netherlands - or where you yourself are located outside the Netherlands.
Final demand letter (WIK letter).
Do you have a claim against a consumer? Then you are required by law to send an official final demand letter before we are allowed to charge collection costs. We call this the WIK letter. We can fully automate this process for you and take it off your hands.
The benefits of outsourcing:
- Legally watertight: We make sure the letter meets all legal deadlines and requirements.
- Instant impact: A letter with Credifin's logo creates significantly more urgency than your own reminder.
- Sharp rates: * Per piece: €15 per letter.
- Large numbers? As little as €5 per letter (excluding VAT).
Judicial Procedure: Your last asset
Sometimes going to court is the only way to get your justice. Although the majority of our cases are resolved amicably, our lawyers are ready if legal proceedings are necessary. This is a separate process that does not fall under 'No Cure No Pay', as we incur external costs in the process.
What should you think about?
- Court fees: The cost of court proceedings.
- Bailiff fees: For officially issuing (serving) the subpoena.
- Legal support: The use of our specialists or a lawyer.
You stay in control: Don't worry, we never just start any procedure. You always receive a free cost-benefit analysis and honest advice about your chances from us first.
Only after your explicit approval of the quotation will we start. This way, you remain in control of the costs and together we make the smartest choice for your company.
Collect outstanding invoice?
Create an account within minutes, submit your claim and immediately see how the costs are structured. Quickly arranged, completely transparent and based on a no cure no pay approach to out-of-court debt collection.
Frequently asked questions about rates and fees
The price of €15 is for occasional jobs where we check and send everything manually. However, do you have a large flow of invoices (for example, for a webshop or association)? Then we can fully automate this process via a link. This efficiency allows us to reduce the rate to € 5 per letter.
When your customer pays the principal amount directly to you, our work has been successful. We then always try to collect the remaining costs from the customer. If, in an exceptional case, this really does not succeed, we will pass on the collection costs to you as compensation for the result achieved. After all, you did receive your money thanks to our process.
This falls under our“improper filing. Because at that moment we start a process that is not yet legally permissible (the customer is not yet officially in default), we have to close the file to avoid legal problems. We will then charge you for the collection costs incurred. So always carefully check the due date before you upload a file!
As you’ll see in our calculation table, by law, amounts received are first offset against expenses incurred and interest. We then, of course, proceed directly to collect the balance.
In our ‘exceptions to the rule’ you can read that in that case we will charge you the collection costs. Because we have already performed work and incurred costs at that time, we can no longer claim these from the debtor if you make a settlement yourself. Therefore, always consult us before you make a settlement; often we can still include those costs in the settlement!
Abroad, we can almost never legally recover collection costs from the debtor. To cover the start-up costs of our international network and the translation of documents, we charge a fixed fee. In addition, we work with a 15% commission on the result, so that we also have maximum motivation to collect your money abroad.
Once you click“send” in our portal, our system immediately goes to work (letters, mailings, file building). If you subsequently withdraw the file, we will charge you for the costs incurred. Did you make a mistake? Then contact us by phone within an hour, and we will still try to stop the activation.
Top experience - always the desired result so far!
