Your right of return

The costs for the collection process are in principle recovered from the webshop, so that (in the event of success) you receive your full purchase price back.

The law is clear: no later than 14 days after you indicate that you are canceling the purchase. The webshop is allowed to wait until they have received the product or until you can prove that you sent it. Once that proof is there, the money must be transferred immediately.

Only if you expressly agree. Have you bought a product and are exercising your legal right of withdrawal? Then you are simply entitled to your money back in your bank account. Don’t be fobbed off with a credit note to a store you’ll probably never want to buy from again.

This is the trickiest situation. In bankruptcy, you are an “unsecured creditor. Unfortunately, the chances of getting your money back through a trustee are slim. However, if you paid with your credit card, you can often still get your money back through your card’s insurance.

If you have a shipping receipt with a Track & Trace code stating that the package was delivered to the web shop (or their pickup point), then the risk lies with the web store. You have fulfilled your obligation. The shop must then investigate the parcel itself, but they may not refuse your refund for this reason.
